Reservation Service Agreement

Making a Booking
When a user is making a reservation with ISLANDTRIPS ONLINE RESERVATION SERVICE he/she should undertake that he/she has the authority to accept these reservation conditions on behalf of user and he/she party. A contract will exist upon our accepting any payment from user towards the booking or upon the issue of our confirmation or itinerary, whichever is the earlier. These conditions in conjunction with the information set out in our published information form the entire agreement between user and ISLANDTRIPS ONLINE RESERVATION SERVICE.

When user make a booking with ISLANDTRIPS ONLINE RESERVATION SERVICE and we accept it, the total cost of the Travel and Tour Package becomes due and payable immediately, unless we have agreed in writing that user should pay an initial deposit. In any event, the full amount of user Travel Package must be credited to ISLANDTRIPS ONLINE RESERVATION SERVICE, a minimum of 30 days BEFORE user scheduled departure. (some services require full payment to confirm booking).

Special Rates
Prices are fixed at the time of reservation and generally will not be subject to any surcharges. The only exception will be an increased in our costs arising as the result of any government action including but not limited to, new or increased taxes such as VAT. When a surcharge is payable an administration charge of $5.00 per person, together with an amount to cover travel agents commission (if applicable) will be added.

(If this means that user have to pay more than 20% of the original booking price user will be entitled to a full refund of all payment paid in respect of user booking, except an amendment charge). Should user decide to cancel because of this then user must exercise user right to do so within fourteen days from the date we advised you of the amount due. Rates are subject to change without prior notice thus they must be reconfirmed at the time of booking. Increases may be expected 10 days before and after Christmas, Chinese New Year, Easter and long holidays.

Rates are quoted in Prevailing Currency.
We reserve the right to change our prices at any time before user book including any special rates that we may offer from time to time, which may not be the same as those published on ISLANDTRIPS ONLINE RESERVATION SERVICE.

Please note that ALL RATES are determined based on the actual time of travel, and NOT the reservation date. In some cases, posted rates may expire or become invalid after the booking date and before the actual date of travel. In this case, we will confirm and charge the new rate that will be in effect at the time of travel.

Changes by User
If user wishes to change user booking with ISLANDTRIPS ONLINE RESERVATION SERVICE he/she may do so, but by accepting such change we will be charging $5.00 each person per amendment provided that user instructions are made in writing and are received at least 60 days prior to user scheduled departure.

3. If user (client) package includes international or domestic air tickets, ISLANDTRIPS ONLINE RESERVATION SERVICE acts as an agent for the airline or any other flight consolidator and the airline or flight consolidators' cancellation or amendment charges shall apply.

4. We shall not be held liable for any commitment not made by us in writing.

5. Once travel has commenced, we shall not refund or exchange any unused portion.

6. We shall not be accountable for cancellations, postponements, revisions or amendments in the means of transportation, menu selection, type of accommodations, schedule of activities and all related circumstances arising from causes beyond our control.

7. Details of these policies can be obtained in other services such as tours and hotels.

ISLANDTRIPS ONLINE RESERVATION SERVICE, THEISLANDTRIPS.COM or DOTCOM INTERNATIONAL MARKETING, INC. will not accept responsibility for the loss, injury, damage, delay or irregularity that may be caused to our Passenger or his property arising from causes due to force majeure.

Amendment of user booking
It is unlikely that we will have to amend user travel and tour package booking. However, occasionally changes may become necessary which we reserve the right to make at any time. Most of these changes are minor and we will advise user at the earliest possible date. Flight times and carriers set out in published material are subject to change and all details given to the user are for guidance only.

Confirmed dates will be shown on user itinerary and air tickets.
Should a material change become necessary, we will inform user as soon as reasonably possible. User may decide whether or not to accept the changes, however user must accept or reject the proposed change in writing within 72 hours of notification, otherwise we will assume that user have accepted the proposed changes.

A material or substantial change is one made to user travel arrangements before departure, involving change of departure or arrival airport (other than between airports within the same city airport system) outward or return flights being re-scheduled by more than 12 hours, or by substitution of accommodation originally booked with one of a lower grade. If we alter the airline, aircraft type operating user flight or routing, this is not considered a material change and we will be under no obligation to notify user of such change in advance.

If user do not wish to accept a material change, we will give user a full refund and in addition, whether or not user accept a material change prior to departure, we will also give user compensation for user inconvenience based on the following:

These are the only forms of compensation that may be paid to user. As we do not control the day-to-day management of user travel and tour package, it is possible that we may be advised that the reserved travel and tour package may not be suitable or available upon user arrival. If this happens, we will endeavor to provide accommodation of at least the same standard, in the same geographic area. If only accommodation of a lower standard is available, then we will refund the difference of the advertised price between the accommodation booked and that available together with compensation of $10.00 per person for user inconvenience.

Insurance
It is a condition of the agreement between us, that user take out adequate Philippine Travel insurance against cancellation charges, unexpected curtailment of user travel, medical expenses arising overseas including repatriation, loss or damage to luggage and personal liability claims against user.

Should user fail to secure such Philippines Travel Insurance coverage prior to user Philippines Travel, then user accept full responsibility for userself and all of the members of user party, and indemnify ISLANDTRIPS ONLINE RESERVATION SERVICE, THEISLANDTRIPS.COM or DOTCOM INTERNATIONAL MARKETING, INC., its officers, directors, stockholders, employees, agents, representatives, affiliates, third party service providers, merchant licensors or the like for any and all costs that may arise, which would otherwise have been met, had such Philippines travel insurance been in force.

IMPORTANT NOTICE: We are not responsible for changes which arises as a result of events outside of our control, such as technical or maintenance problems with transportation, changes imposed by re-scheduling or cancellation of flight schedule by an airline, or main charter company, war or threat of war, civil strife, industrial disputes, natural disasters, bad weather or terrorist activity.

Complaints
We do our VERY BEST to ensure that user travel and tour package arrangements will proceed according to agreements. However, if user have a complaint arising out of what we have agreed to provide for user, please let us know at the earliest possible opportunity. If necessary by calling our main office at +63-910-9674754, or our 24 hour emergency hotline at +63-910-9674755, from wherever user may be. If a problem arises during user’s Philippine trip, please contact us immediately, so we can extend help.

If user’s complaint cannot be resolved locally, user should advise us within 30 days of the incident, in writing, by giving user ISLANDTRIPS ONLINE RESERVATION SERVICE confirmation number, a detailed description of user complaint and other relevant information. Please Note: that if user do not follow our complaint procedure, we CAN NOT accept responsibility for user complaint, as we would have been deprived of the opportunity to investigate the matter on user behalf, and where possible, help user to resolve the problem.

Applicable Law
Any contract or dispute arising from Philippine booking conditions shall be governed by and construed in accordance with Philippines laws. Both parties agree to submit to the sole and exclusive jurisdiction of the Courts of Makati City, Philippines.
